These terms and conditions apply to all orders that individuals conduct through the online store ‘Kreta Keramik’, Hauptstrasse 51, 67229 Grosskarlbach
(hereinafter “Kreta Keramik”).

The presentation of products in the online shop is not a legally binding offer, but a noncommittal online catalogue. By clicking the order button, a binding order of the items in the shopping cart has been conducted. The confirmation of the order takes place together with the acceptance of the order immediately after through sending an automated email. With this e-mail confirmation of the purchase the contract has been concluded.
The prices described on the product pages include VAT and other price components. Postage will be added on separately.
4.1 For delivery within Germany we charge max. £45 per order.
5.1 The choice of the route and means of transport is up to the seller.
5.2 The delivery time, unless otherwise stated in the offer, usually takes 2-5 days.
5.3 If not all products ordered are in stock, we are entitled to partial deliveries at our expense, as far as is reasonable for you.
5.4 If the delivery of the goods fail after three delivery attempts, we can withdraw from the contract. When applicable payments will be refunded immediately.
5.5 If the ordered product is not available, because we are not supplied with this product by our suppliers without our own fault, we can withdraw from the contract. In this case, we will inform you immediately and may propose to supply a comparable product. If no comparable product is available or you do not want a comparable product, we will refund –if applicable- without delay.
Payment for the goods is possible either via PayPal, credit card, in advance, PayPal or through immediate bank transfer. We accept Visa, MasterCard / Euro Card and American Express. Regardless of the chosen method of payment, the customer receives an invoice showing VAT. The credit card will be charged immediately and before delivery of the goods.
The goods remain our property until full payment. Before transfer of ownership the use of the item as pledge, as security transfer, or any processing or transformation of the item is not allowed without our agreement.
8.1 Consumers have a two-week period within which the withdrawal from the contract is possible.
You have the right to withdraw from this contract within fourteen days without giving a reason. The withdrawal period is fourteen days from the date, you or a representative of your third party known to you, other than the carrier, took possession of the goods.

To exercise your right, you must inform us by a clear statement (e.g. by mail or email) of your decision to withdraw from this contract.
You can complete and submit a clear statement on our website electronically. When you make use of this possibility we will immediately send an acknowledgment of receipt of the withdrawal.
To meet the withdrawal deadline, it is sufficient that you send your communication concerning the right of withdrawal before the end of the withdrawal period.
Consequences of withdrawal
If you withdraw from this contract, we will reimburse all payments we have received from you, including the costs of supply (with the exception of the additional costs arising from the fact that you have chosen a type of delivery other than that offered by us), and repay immediately latest within fourteen days from the date on which the notification has been received about your cancellation of this contract with us.
For this repayment, we use the same method of payment that you used in the original transaction, unless you explicitly agreed otherwise; in no case you will be charged fees for this repayment.
We will pick up the goods. You will bear the direct cost of returning the goods at the same level, which have been calculated in the initial delivery. More information about our shipping costs can be found here.
You only need to pay for any diminished value of the goods, where the value loss is due to the unnecessary handling the goods other than to determine its nature, characteristics and functioning.
9.1 If the goods are delivered with obvious damages, please file a complaint immediately to the deliverer and please contact us as soon as possible on +49 (0) 6238-929008.
9.2 The failure of a complaint or contact has no consequences for your statutory warranty rights but help us to make our own claims against the carrier or the transport insurance.
The warranty is subject to legal regulations.
We exclude our liability for negligent breach of duty unless they relate to contractual obligations, damages resulting from injury to life, limb or health or guarantees or claims under the Product Liability Act. The same holds for any of our agents.
12.1 If any provision of these terms and conditions be invalid, the contract will remain valid. Instead of the invalid provision, the relevant statutory provisions fall into place.
12.2 These terms are subject to the law of the country where the company has its headquarters. The CISG does not apply here.
